Terms of Service

1. About Bottle Scout

Bottle Scout (the "Service") is a subscription software service operated by Bottle Scout ("we", "us", "our") that delivers real-time inventory alerts for allocated bourbon at major U.S. retailers.

We are a notification service only. We do not sell, ship, deliver, or otherwise transact in alcoholic beverages, and we are not affiliated with any retailer or distillery mentioned in our service. All purchases of alcohol are made by you directly from the third-party retailer under that retailer's own policies, licensing, and pricing.

2. Eligibility

You must be at least 21 years of age (or the legal drinking age in your jurisdiction, whichever is greater) to use this Service. By signing up, you represent that you meet this age requirement, are not prohibited from receiving services under U.S. law, and will comply with all applicable local laws regarding the purchase of alcohol.

3. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity on your account. Notify us immediately at [email protected] if you suspect unauthorized access. On the Barrel Proof tier, only one device may be signed in at a time; signing in on a new device automatically signs out other sessions.

4. Subscription & Billing

• Plans. Bottle Scout offers a free Scout tier and paid subscription tiers (Single Barrel and Barrel Proof). Current pricing and features are listed at bottlescout.io/#pricing.
• Billing. Paid subscriptions are billed monthly via Stripe. You authorize us (through Stripe) to charge your payment method on the same day each month until canceled.
• Free trial. New paid subscribers receive a 7-day free trial. Your payment method is required to start the trial but will not be charged until the trial ends, unless you cancel during the trial.
• Cancellation. You may cancel anytime from your account dashboard. Cancellation takes effect at the end of the current billing period.
• Refunds. We do not offer refunds for periods already billed, except where required by applicable law.
• Price changes. We may change pricing with at least 30 days' notice via email. You can cancel before the new price takes effect.

5. Acceptable Use

You agree NOT to:

• Resell, sublicense, or redistribute Bottle Scout data, alerts, or content
• Scrape, crawl, or otherwise automatically extract data from the Service
• Share your account credentials or use the Service to give others access
• Use the Service to facilitate the resale of alcohol at above-retail prices
• Use the Service for any unlawful purpose, including underage purchasing or interstate alcohol shipment in violation of state law
• Interfere with, disrupt, or attempt to bypass any security or rate-limit mechanism

6. Intellectual Property

All Service content, code, designs, trademarks, and data are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal use during your active subscription. No other rights are granted, express or implied.

7. Data Accuracy Disclaimer

Bottle Scout sources inventory data from publicly available retailer APIs and websites. We make every reasonable effort to keep alerts accurate and timely, but retail inventory changes constantly and we cannot guarantee that a bottle reported as in-stock will still be available when you arrive at the store. You are responsible for verifying availability with the retailer before traveling.

8. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, or noninfringement. We do not warrant that the service will be uninterrupted, error-free, or that any inventory data will be accurate.

9. Limitation of Liability

To the fullest extent permitted by law, our aggregate liability for any claim arising out of or relating to the service will not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100). In no event will we be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion, with or without notice. Upon termination, your right to use the Service ends immediately. Sections 6, 7, 8, 9, 11, and 12 survive termination.

11. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via email to your registered address at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict of laws principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Maricopa County, Arizona, and you consent to personal jurisdiction there.
